Staff Reporter: Expatriate Bangladeshis have been shocked by the immoral activities of Shah Nawaz, a home care businessman in New York, USA. The Pay-Check Protection Program (PPP) obtained in his two home care businesses resorted to fraud by keeping confidential (waiver) loan information from a partner. Asking for the exact amount and account of the loan, he lodged a complaint with the police alleging that he had beaten and tried to kill the partner with the intention of harassing him. Bangladeshi expatriates in New York were shocked to learn that Partha Gupta, a former partner and well-known face of New York’s cultural scene, had been detained at a police station for questioning. The incident has caused a storm of condemnation in the Bangladeshi community in New York and other US states.
At 1:29 am on September 10, Shah Nawaz (aka Shah Mohammad Nawaz, aka Shah M Nawaz, aka Mohammad S Nawaz) went to the City Police Department’s Northern Boulevard-115 area in Jackson Heights and complained that his former business partner was Partha Gupta. Sent him a text message threatening to kill him. Two months ago, on August 29, at a street event organized by Bangladeshis on 76-37 Street in Jackson Heights, he was beaten by a group of people, including Partha Gupta, a former partner of Golden Age Home Care, at around 6:00 to 6:30 pm. During this time they displayed dangerous devices (pistols, revolvers, rifles, shotguns or machine guns) intended to kill him (docket number – ‘CR-020560-21QN’). That is he wants the help of the police for the safety of his life. Following his allegations, Tayler Scala, a police officer in the Northern Boulevard-115 area of Jackson Heights, called Partha to the police station for questioning on the evening of October 4 (Monday). After receiving the phone call, Partha voluntarily went to the police station and detained him there till night after interrogation.
The next day, October 5 (Tuesday), a wise Criminal Court judge granted Partha bail. The court also directed to maintain distance from the plaintiff Shah Nawaz. Most recently, he tried to harass another musician with the same police officer. The musician named Rajeeb was an employee of his Golden Age Home Care. Shah Nawaz fired Rajib for sending a text message at 2:49 pm on July 7 this year during the Corona epidemic due to his participation in Partha Gupta’s ‘Mati Band’ concert. According to various sources, Shah Nawaz is threatening to re-arrest Partha for fear of the court order to keep distance.
An investigation into the conflict between Shah Nawaz and Partha Gupta’s home care business revealed that the Corona epidemic in the United States last year led to a pay-check protection program (PPP) loan by the federal government to various businesses, including small ones. In his two home care businesses (Bengal Home Care Inc. and Golden Age Home Care), he allegedly defrauded the US Central Government of 5,24,729 (about Tk 4,46,1,965 in Bangladeshi currency) through fraudulently employing 140 employees. ) Pay-Check Protection Program (PPP) Loans.
At the end of 2016, the Board of Directors of Bengal Home Care Inc. was reconstituted. Partha Gupta was elected director on the board of directors. At the time of the dividend policy, Shah Nawaz and another partner were given a 45 per cent dividend and Partha Gupta a 10 per cent dividend. After the reconstitution of the board of directors, Partha Gupta collected 80 percent of the patients of this institution. His talent and tireless work day and night made the organization pioneering and popular, but the amount of his dividend is much less than the work. Partha realizes that he is not making as much money as he used to. Partha was thinking of leaving the organization. At that time Partha fell into the trap of Shah Nawaz’s deception. In March 2020, Shah Nawaz received 25,000 from Perth in the first installment and another 51,000 in the second installment to jointly purchase Golden Age Home Care from US businessman Marian Hernen. According to the verbal agreement, the name of Partha was supposed to be attached to any other official work including the health department and bank account, but Shah Nawaz did not do so. Partha repeatedly raised questions about this.Today will be tomorrow, Shah Nawaz will spend time. Prior to the launch of Golden Age Home Care Inc., it was decided to retain Shah Nawaz as President and CEO and Partha Gupta as Vice President. A month later, in the absence of Partha, Shah Nawaz cleverly nominated his wife Amena Nawaz alias Rano Nawaz as his senior vice president. Despite objecting to this, Partha did not get any result. Shah Nawaz promised to pay 25 percent dividend to Partha Gupta. But by cleverly appointing his wife as senior vice president on the board of directors, Amena Nawaz decided to take a dividend of 20 per cent, Partha Gupta 20 per cent and Shah Nawaz 60 per cent. Thus, in each case, Partha has been deceived by Shah Nawaz. Even if the business was fully operational, Shah Nawaz would not give any account to Partha. Partha also recruits 80 percent of patients and invests 76,000 in the institution. It is unknown at this time what he will do after leaving the post. However, the idea is that Partha’s share of the money is more and the dividend is less. Conflict and Depression arose between the two on these various issues. Communication was limited and no talks were held for a long time, the source said.
Meanwhile, the Pay-Check Protection Program (PPP) has started getting loans in the name of various businesses in New York. Partha wants to know from Shah Nawaz whether Bengal Home Care Inc. and Golden Age Home Care Inc. have received PPP loans. In reply he said the application has not been made yet. On May 19 this year, 31 employees of Golden Age Home Care received 80,690 and 109 employees of Bengal Home Care Inc. were granted PPP loans of 444,039. After receiving the loan approval letter, Shah Nawaz suddenly told Partha to engage in a deliberate quarrel with another partner. Even then, Partha did not know about the loan approval of their organization. Arguing with another partner in Partha, Shah Nawaz secretly argued with him and the Bengal Home Care’s Pay-Check Protection Program (PPP) borrowed money from Citibank and shared it between the two. It is learned that Shah Nawaz adopted a new strategy to deprive Partha Gupta of the Bengal Home Care dividend. Partha and Shah Nawaz signed a memorandum of understanding on June 7 this year to return the Bengal Home Care loan to its former owner after the money was shared between them.
The reporter spoke to Bangladeshi expatriates of various professions in New York while investigating the beating and attempted murder of home care businessman Shah Nawaz by New York instrumentalist (keyboard player) Partha Gupta. None of them can simply accept this fact. They termed Shah Nawaz’s allegation as false and conspiratorial.
Shah Shahidul Haque (Sayed), the organizer of the Pathmela at 76-37 Street in Jackson Heights and President of World Human Rights Development USA, said that the incident was a disgusting one. Shah Nawaz has belittled himself by making such a false accusation in the name of an innocent man, identifying himself as a community leader. He said the allegation made by Shah Nawaz to the police was completely false as he was the organizer of the Pathmela. There was a round-the-clock police guard system. Partho played the keyboard on stage from 12 noon to 8 pm. He was also present there all the time. The police and the organizers were the first to know when such an unpleasant incident (beating and display of guns) took place at around 6 pm to 6:30pm. Shah Nawaz did not complain to anyone. He did not even voluntarily call the police. This proves that the incident is false and fabricated.
Pathmela sound controller and vocalist Tanvir Shaheen said he had been at the fair all day and had not heard of any such incident. Shaheen thinks he will be in danger if he fails to prove the way Shah Nawaz fabricated false allegations against his business partner Partha. He strongly condemned the incident.
Shahid Hasan, an artist and vocalist of Swadhin Bangla Betar Kendra, said that he had heard about the arrest of Partha Gupta from various newspapers and people. Partha’s involvement in such an incident does not seem credible to him, as he has known Partha for a long time. It is not possible for him to do such a thing as beating and showing a gun to someone. They both live in the same building, but Partha has never heard of anyone abusing or insulting anyone. If Shah Nawaz fails to prove the way the allegations are framed, the consequences will be dire.

Fakhrul Islam Delwar, a community activist and businessman, said there was a long-running business dispute between Partha Gupta and Shah Newaz. This problem could be solved by themselves. It was not right for the police to go to court with such a complaint. There is still time to settle their business disputes by compromise, otherwise the situation will get worse, he said.
Khandaker Masud Rahman, a prominent New York expatriate doctor, said Shah Newaz’s home is in Khulna. He is also from the same area but he does not know him that way. I met him in New York. Sometimes we talk when we meet. I have never seen him in Khulna in the country. He does not even know where he studied. He says he does not deserve to come close to the edge of our family personality and situation. That is why no friendship was ever formed with him. But what happened between Partha Gupta and Shah Nawaz is not at all desirable to the people of the society. He hopes that no such incident will happen again.
A well-known New York businessman and community activist speaking on condition of anonymity said, Shah Nawaz had made false allegations against Partha by influencing Al Taheri, the police chief commanding officer in the Northern Boulevard-115 area of Jackson Heights, with false and misleading information. Shah Nawaz told police he owns a plaza in Jackson Heights. He is a great leader in the community. He has friendships and closeness with US politicians and city authorities. He has made a story with such an identity. He himself spoke to police officer al-Taheri after learning of the incident. He asked why Partha Gupta had sent a text message to Shah Nawaz on September 10 threatening to kill him, but why did Shah Nawaz not go to the Jamaica police station but he go the Northern Boulevard-115 area police? His home is in Jamaica. Shah Nawaz is going to face great danger to cover up his crime. Soon the expatriate Bangladeshis will see it.
Asked by several New York-based weekly editors and journalists about the incident between Partha Gupta and Shah Nawaz, they said on condition of anonymity that almost every Bangladeshi home care trader has a Pay-Check Protection Program (PPP) loan fraud. The allegations leveled by Shah Nawaz against his former police partner to cover up such crimes are reprehensible. New York journalists and editors do not have the courage to go deep into the incident and reveal the truth. Because for years Shah Nawaz has kept the mouths of newspapers closed with advertisements of his business establishment. They first saw the detailed news of this incident online in Bangla Press. They also thanked Bangla Press for publishing such courageous news.
Partha Gupta’s lawyer, Cary London, said many had lodged such complaints with police at various times, but the plaintiffs had failed to prove it in court. He thinks this case is similar. Cery said the case is set to be heard in the second week of January 2022. He thinks that the case can be settled in days. After that if Partha Gupta wants, he can file a defamation suit against plaintiff Shah Nawaz, said lawyer Cary London.
Before the first news was published in Bangla Press, Shah Nawaz, President and CEO of Bengal Home Care and Golden Age Home Care, was asked through Facebook message: Have you filed a case against a partner for seeking account of PPP loan of Bengal and Golden Home Care? You need specific feedback on the news. Hope to cooperate with detailed information. Thank you-Bangla Press. He did not answer this question. A few days later, he sent a rejoinder on Facebook Messenger to the news published in an anonymous newspaper and urged to publish it. Shah Nawaz also threatened to take legal action or file a case if he did not publish rejoinder.
