Chhabed Sathee: A New York criminal court has dismissed a false case of a Bangladeshi expatriate businessman living in the United States with a fake death threat by a instrumentalist. Shahnawaz a business partner falsely accused police of putting firearms through Photoshop in his Facebook photo to defeat Partha Gupta an expatriate businessman and popular instrumentalist. At the virtual first hearing at 9:30 a.m local time on Wednesday (January 12), wise judge Mary L. Bejarano of the Queens County Criminal Court in New York dismissed the case.
At 1:29am on September 10 last year, Shahnawaz (aka Shah Mohammad Newaz, aka Shah M Newaz, aka Mohammad S Newaz) went to the police in the Northern Boulevard-115 area of Jackson Heights of New York City Police Department and complained that his business ex Partner Partha Gupta sent him a text message threatening to kill him. Two months earlier, on August 29, at a street fair organized by Bangladeshis on 76-37 Street in Jackson Heights, he was beaten by a group of people including Partha Gupta a former partner of Golden Age Home Care and a popular instrumentalist at around 6:30 pm. During this time they displayed dangerous devices (pistols, revolvers, rifles, shotguns or machine guns) for the purpose of killing him (case docket number – ‘CR-020560-21QN’). He sought help of police for the safety of his life. Following the allegations, Taylor Scala, a police officer in the Northern Boulevard-115 area of Jackson Heights, called Partha to the police station for questioning on the evening of October 4 last year. After receiving a phone call, Partha Gupta voluntarily went to the police station and detained him at the Northern Boulevard-115 police station till night after interrogation.
The next day, on October 5 Parth Gupta was sent to the nearest criminal court and the wise judge granted him bail. The court also directed to maintain distance from the plaintiff Shahnawaz.
Shahnawaz a New York home care and insurance businessman dismissed the case (CR-020560-21QN) arranged and planned. As a wise judge of the Queens County Criminal Court in New York for failing to substantiate his allegations. The court also acquitted businessman and instrumentalist Partha Gupta.
After dismissal of the case Partha Gupta’s lawyer Cary London, Esq. told the US media Bangla Press that Partha Gupta was completely innocent. Because he can’t point a gun at anyone while playing instrumental music with the performers on stage. Even at the fair organized by Bangladeshis on 76-37 Street in Jackson Heights on August 29 last year, no such incident took place. Shahnawaz a business partner also falsely accused the police of threatening to defeat Partha Gupta by placing a firearm in his Facebook photo to injure him. He said many people have lodged such complaints with the police at different times, but the plaintiff failed to prove it in court.
Asked what he planned to do next in the case, lawyer Cary London told the Bangla Press: “We are planning to bring the liar Shahnawaz under the law. Otherwise, the number of such false allegations will continue to increase in the society to defeat the opponent. I have decided to file a defamation suit for this.
After being acquitted in court Parth Gupta told the US media Bangla Press that he urged the expatriate Bangladeshis to be vigilant so that no other expatriate Bangladeshi like me would fall prey to such bad people and be harassed. He said that there are many ‘calprites’ in the society who are such sweet-speaking, masked people. Partha also urged them not to befriend anyone without knowing their insides. He sincerely thanked all those who had helped and advised him since the false allegations were made against him.
Shahnawaz a New York-based home care businessman in the United States sought refuge in Partha Gupta a business partner by keeping secret the information on the Pay-Check Protection Program (PPP) loan (waiver) obtained from two home care businesses. Shahnawaz a businessman accused the police of threatening to defeat Partha Gupta the partner by placing firearms in his Facebook photo through Photoshop to harass him.

Shahnawaz and Partha Gupta’s Home Care Business Conflict: Last year, the Corona epidemic in the United States escalated, prompting the federal government to provide Pay-Check Protection Program (PPP) loans to various businesses including small ones. At the end of 2017, the Board of Directors of Bengal Home Care Inc. was reconstituted. Partha Gupta was elected director of the board. At the time of the dividend policy Shahnawaz and another partner H M Jamil, were given a 45 per cent dividend and Partha Gupta a 10 per cent dividend. After the reconstitution of the board of directors Partha Gupta collected 80% of the patients of this institution. His talent and untiring work day and night made the organization pioneering and popular, but the amount of his dividend is less than the work. Partha realizes that he is not earning as much as he used to. Partha was thinking of leaving the organization. At that time Partha fell into the trap of Shahnawaz’s deception.
In March 2020, Shahnawaz received $ 25,000 from Partha in the first installment and another $ 51,000 in the second installment to jointly purchase Golden Age Home Care from US businessman Marion Hernen. According to the verbal agreement, the name of Partha was supposed to be attached to any other official work including the health department and bank account, but Shahnawaz did not do so. Partha repeatedly raised questions about this. Today will be tomorrow, Shahnawaz will spend time. Prior to the launch of Golden Age Home Care Inc., it was decided to retain Shahnawaz as President and CEO and Partha Gupta as Vice President. One month later, Shahnawaz invisible in Partha very cleverly nominated his wife Amena Nawaz alias Rano Nawaz for the post of Senior Vice President. Despite this Partha did not get any result. Shahnawaz has promised to pay 25 per cent dividend to Partha Gupta. But by cleverly appointing his wife as senior vice president on the board of directors, Amena Nawaz decided to take 20 per cent, Partha Gupta 20 per cent and Shahnawaz 60 per cent dividends. Thus in each case, Partha fell victim to Shahnawaz’s deception. Even if the business was fully operational, Shahnawaz would not give any account to Partha. Partha also recruits 80 percent of its patients and invests 76,000 in the institution. It is unknown at this time what he will do after leaving the post. However, the perception is that Partha’s share money is more and dividends are less. Conflicts and disagreements arose between the two regarding these various issues. Meanwhile, the Pay-Check Protection Program (PPP) has started getting loans in the name of various New York merchants. Partha wants to know from Shahnawaz whether Bengal Home Care Inc. and Golden Age Home Care Inc. have received PPP loans. In reply, he said that the application has not been made yet. On May 19 this year, 31 employees of Golden Age Home Care received $80,690 and 109 employees of Bengal Home Care Inc. were approved to allocate PPP loans of $444,039 against them. After receiving the letter of approval for the loan Shahnawaz suddenly told Partha to get into a deliberate quarrel with another partner H M Jamil. Even then, Partha did not know about the loan approval of their organization. After quarreling with another partner in Partha, Shahnawaz secretly argued with him that both Bengal Home Care’s Pay-Check Protection Program (PPP) loan money was withdrawn from Citibank by Shahnawaz and H M Jamil. It is learned that Shahnawaz has adopted a new strategy to deprive Partha Gupta of the Bengal Home Care dividend. Partha and Shahnawaz signed a memorandum of understanding on June 7 this year to handover the Bengal Home Care to H M Jamil, the former owner of Bengal Home Care.
