SC to deliver Jamaat-e-Islami registration verdict on 1 June
Bangla Press Desk: The Supreme Court on Wednesday fixed 1 June for delivering its judgment on the appeal filed by the Bangladesh Jamaat-e-Islami seeking the restoration of its registration as a political party and the return of electoral symbol. The 1 June judgment is expected to have significant implications for the party's political future. A four-member bench of the Appellate Division of the Supreme Court led by Chief Justice Syed Refaat Ahmed fixed the date of declaring verdict after concluding hearing from both sides. Senior lawyer Barrister Ehsan Abdullah Siddiq argued in favour of the Jamaat’s appeal, assisted by Barrister Imran Abdullah Siddiq, Advocate Mohammad Shishir Manir and Barrister Najibur Rahman Momen. On the other side, Advocate Towhidul Islam represented the Election Commission (EC).
The acting secretary general of Jamaat-e-Islami, Maulana ATM Masum, assistant secretary general Advocate Ehsanul Mahbub Zobair and some other central leaders of the party were present in the court. The final day of hearing in the case resumed on Tuesday and was extended to Wednesday as proceedings could not be completed earlier. The appeal hearings began on 12 March this year. Jamaat-e-Islami received registration from the EC on 4 November 2008. Some 25 individuals, including leaders of the Bangladesh Tarikat Federation, challenged Jamaat’s registration in the High Court. Despite multiple amendments to its constitution, including renaming itself as ‘Bangladesh Jamaat-e-Islami’ from Jamaat-e-Islami Bangladesh, the High Court on 1 August 2013 declared the party’s registration illegal based on a majority opinion from a larger bench. Later on 7 December 2018, the EC cancelled Jamaat's registration.
The Appellate Division dismissed the appeal of Jamaat-e-Islami as ‘dismissed for default’ in November 2023. As a result, the High Court’s verdict declaring Jamaat’s registration as a political party illegal remained in effect. Following the political changeover and downfall of the autocratic Sheikh Hasina-led Awami League regime on 5 August 2024, Jamaat-e-Islami filed an application with the apex court to revive its registration case, arguing that Jamaat’s lawyers were absent during the appeal hearing. The Appellate Division on 22 October 2024 granted Jamaat’s application. Source: DS [Bangla Press is a global platform for free thought.
