Notice Served After Police Decline FIR in DUCSU Assault Case
Bangla Press Desk: A legal notice has been served to the authorities concerned, seeking the immediate filing of a First Information Report (FIR) over the alleged assault on several leaders of the Dhaka University Central Students’ Union (DUCSU) and hall unions inside Shahbagh Police Station.
The notice was sent on Tuesday by DUCSU Social Welfare Secretary AB Zubayer through Supreme Court lawyer Advocate Mohammad Saddam Hossain. It was addressed to the Senior Secretary of the Public Security Division, the Inspector General of Police (IGP), the Commissioner of Dhaka Metropolitan Police (DMP), the Deputy Commissioner of Ramna Division, and the Officer-in-Charge (OC) of Shahbagh Police Station.
According to the notice, a fake photocard in the name of Abdullah Al Mahmud, a student of the University of Dhaka, was circulated on social media around 6:30 pm on April 23. When he went to Shahbagh Police Station to file a complaint, around 100–120 activists of Jatiyatabadi Chhatra Dal allegedly confined him inside the station.
Upon receiving the news, Md Sayeduzzaman Nur Alvi, an executive member of Surja Sen Hall Union, went to the scene and was reportedly assaulted. Later, AB Zubayer, along with other DUCSU leaders and representatives, arrived at the police station around 7:00 pm.
The notice further alleged that after entering the station, Chhatra Dal activist Junaid Abrar physically assaulted Zubayer, while others, including Alamin, Shah Muhammad Rubayet and Saikat Morshed, struck him on the head, causing serious injuries. At the same time, Ratul, Radil, and 30–35 unidentified attackers reportedly assaulted both Zubayer and Musaddiq.
The victims reportedly took shelter in a room inside the police station to escape the হামলা, but were followed and attacked again. Later, other students rescued them and admitted the injured to Dhaka Medical College Hospital. After receiving treatment, they were discharged with medical certificates.
The notice also stated that on April 26, after completing treatment, Zubayer went to Shahbagh Police Station to file a formal complaint with specific allegations. However, the OC allegedly refused to record it as an FIR.
Citing Section 154 of the Code of Criminal Procedure, Rule 244(a) of the Police Regulations of Bengal (PRB) 1943, and the judgment in the Naripokkho vs Bangladesh case, the notice said police are legally bound to register an FIR upon receiving information about a cognisable offence.
The notice urged the authorities concerned to take immediate steps to accept the FIR and warned that legal action would be pursued if necessary measures are not taken promptly.
