Berger Montague served as lead counsel in the wage-and-hours litigation and secured the $725,000 settlement on behalf of approximately 323 home health aides who worked for Golden Age Home Care in the United States during the relevant period. The plaintiffs were represented by Berger Montague attorneys Shannon J. Carson and Camille Fundora Rodriguez.
The lawsuit alleged violations of the federal Fair Labor Standards Act (29 U.S.C. § 201 et seq.) as well as Pennsylvania state labor laws. The case was litigated in the U.S. District Court for the Eastern District of Pennsylvania under the caption Thorpe v. Golden Age Home Care, Incorporated, No. 2:17-cv-01187-TR (E.D. Pa.).
The plaintiffs were non-exempt, hourly home health aides employed by Golden Age Home Care to provide in-home services to elderly and disabled clients. They routinely worked well over 40 hours per workweek, but were paid only their regular hourly rate and did not receive overtime pay for hours worked beyond 40. In addition, they were not compensated for travel time between clients’ homes during the workday.
The plaintiffs claimed they were not paid for all hours worked and were denied overtime wages required by law. The settlement resolves all claims raised in the lawsuit.
